As a user, you acknowledge the use of our website and any transactions made will be subject to our Terms and Conditions mentioned below. Here, the users are referred to as “you” or “your” and Hex Store as “we” or “us”.

Ordering Through Our Website

By placing orders on our website, you justify that are you lawfully capable of establishing a binding contract.

As per our Privacy Policy, we are entitled to ask you for supplying your personal information, without limitation, including name, address, phone number, e-mail, credit card number and associated details, and shipping information. By submitting relevant details, you not only justify that the information is true to your knowledge but that you are also eligible to legally use any debit or credit cards you listed with our website. This is also applicable in situations where you create an account with us. Failure to do so will be considered as a breach of Terms and Conditions. However, we guarantee safeguarding your password that you use to create an account with us. You also give use the permission to share and use your information as per our Privacy Policy.

Order Cancellation

If we suspect illegal or unauthorized transaction or fraudulent activity, we reserve the right to refuse and cancel your order right away. We do not support fraud and theft and are on a careful lookout for such activities.

Hex Store or its suppliers are not liable to incidental, consequential, indirect, or special damages that are may be a result of your or third-party’s loss or profit, loss or privacy, inappropriate data use, whether in contract or action, arising from your access to, or use of the site or any content provided on or through the site, even if the company or the suppliers had been warned of such potential damages.

Governing Law

The Kuwaiti laws and regulations govern our Terms and Conditions. Your use of our website and store are also subject to local and international laws, which are applicable on our sales of goods and services.

Disputes

In case of any disputes, complaints, and concerns regarding the store and service, you agree to first resolve the dispute by contacting us on our email or customer service center number.

Severability and Waiver

If any of the provisions of these Terms are held invalid or unenforceable, such provision will be modified and interpreted to comply with applicable law, while other provisions will continue in full force and effect.

No provision of these terms and conditions shall be waived, modified, or discharged, unless agreed to in writing and signed by the company. Unless as given below, the failure to exercise a right or to require performance of an obligation under this Terms shall not affect a party’s ability to exercise such right or require such performance at any time thereafter nor shall be the waiver of a breach constitute a waiver of any subsequent breach.

Hex Store Secure Online Payment System

The customers can make whole or part payments for their purchases through payment features offered by the Hex Store. Apart from cash on delivery option, we accept most credit or debit cards, from which we cut payment after we have examined your card details and received your order for relevant products. The products are then sent to delivery and subject to availability. In case of unavailability, the full amount is refunded immediately. To ensure cards are used with your consent, we direct you to selected card’s payment gateway where you enter card details. The personal information may be validated here and might be disclosed to concerned credit reference agency, which are registered. This is done to confirm customer’s identity and does not impact their credit rating. At all times, we ensure customer privacy and security.

In this regard, the relevant bank is responsible for verifying customer information and deducting the payment. The Hex Store shall not be liable for any theft, fraudulent activity, damages, or losses occurring due to illegal transactions, breaches, and cyber-attacks on the concerned bank. The price for each product is the one you received at the time of the order. While we ensure these prices are listed with accuracy, any discrepancies will be informed soon. In such case, the orders are reconfirmed. In case we fail to contact you, the orders will be cancelled and you will receive a full refund. All prices listed on the website are in Kuwait Dinars and are inclusive of taxes but exclude delivery charges.

Cash-on-Delivery Payment

To our registered users, we also offer cash-on delivery option. The cash should be given on spot to our delivery representative prior to receiving the ordered products. The customers will receive the order on making the payment with delivery note and invoice. For customer’s convenience and ease, each customer will be informed of delivery, 30 minutes prior to it. In case the person is not at home, the representative would wait for an hour before pushing the delivery to the next day. In case of failure to contact subsequently, the order will be cancelled automatically. No products can be held by customers on credit and no COD option is available on pre-order products, except stated otherwise on the webpage of a certain product.
